1. Rental package, payment and term
The renter is hiring the selected package of reusable 27-gallon totes and dollies, plus any selected add-ons, for up to fourteen calendar days and any prepaid extension shown in the reservation. Payment is due before delivery. A request is not confirmed until South Florida Tote Rentals accepts it and payment is received.
2. Add-ons and extensions
Additional totes are $3 each per week, charged as $6 per extra tote for the initial two-week rental. Additional dollies are $15 each per rental. Optional extension weeks are charged at the package's published weekly extension price. Extensions requested after booking depend on availability and must be approved and paid before the scheduled pickup date.
3. Included service area
Standard delivery and pickup are included for addresses within Palm Beach County. Nearby areas may be available for an additional delivery charge disclosed and approved before payment. Access restrictions, stairs, gates, elevators and parking requirements must be disclosed when booking.
4. Cancellation and rescheduling
The renter may cancel or reschedule without charge at least 48 hours before the scheduled delivery window. A cancellation or rescheduling request made less than 48 hours before delivery may incur a $50 scheduling fee. After delivery, the rental charge is nonrefundable. If the company cannot fulfill a confirmed reservation, the renter will receive a full refund of amounts paid for that reservation.
5. Late returns
The renter must make all equipment available on the scheduled pickup date. Unapproved overdue time is charged at the selected package's published weekly extension price plus a $25 late fee for each additional week or any portion of a week. Continued fees do not transfer ownership of the equipment.
6. Loss, theft and damage
The renter is responsible for every tote and dolly from delivery until it is counted, inspected and accepted at pickup. The renter agrees to pay $20 for each tote and $75 for each dolly that is lost, stolen, missing, destroyed, altered or damaged beyond ordinary wear and tear. Delivery and pickup counts and condition photographs may be used to document the rental.
7. Proper and safe use
Totes and dollies may be used only for lawful household or office moving and storage. Each tote must remain safely liftable and may not exceed 50 pounds. Do not place people, animals, liquids, unpackaged food, weapons, hazardous, flammable, corrosive, illegal, contaminated, excessively sharp or leaking materials inside. Do not ride, stand on, drill, cut, paint, permanently label or modify the equipment. Keep all equipment indoors or otherwise protected from weather and unauthorized access.
8. Condition, cleaning and access
The renter will inspect the totes at delivery and promptly report existing damage. Totes must be returned empty, reasonably clean, closed and accessible at the agreed address and time. Excessive cleaning is $35 per rental. A failed delivery, failed pickup or renter-requested redelivery caused by inaccurate information, denied access or unavailable totes is $50 per occurrence.
9. Locations and permission
The renter is responsible for obtaining permission for delivery, storage and pickup at apartments, gated communities, storage facilities, offices and other properties. The renter must provide safe, lawful access and accurate gate, unit, elevator and parking information. Responsibility begins when the totes are delivered and ends after the company completes its pickup count and inspection.
10. Personal property and assumption of risk
The renter is responsible for packing, loading, securing, transporting and protecting all personal property. South Florida Tote Rentals is not responsible for loss of or damage to contents, vehicles, buildings or other property arising from packing, lifting, transport, storage, weather, misuse or unauthorized use, except to the extent caused by its gross negligence or willful misconduct.
11. Indemnity and limitation of liability
To the fullest extent permitted by Florida law, the renter agrees to defend, indemnify and hold South Florida Tote Rentals and its owners, employees and agents harmless from third-party claims, injuries, losses or expenses arising from the renter's possession or use of the totes, except to the extent caused by the company's gross negligence or willful misconduct. Any company liability related to the rental is limited to the amount paid for that rental, to the fullest extent permitted by law.
12. Authorization for additional charges
If the renter provides a payment method through the company's secure payment processor, the renter authorizes documented charges that are expressly allowed by this agreement for late return, missing or damaged totes, excessive cleaning, failed service or redelivery. The company will not store the renter's full card number and will provide an itemized notice of additional charges.
13. Electronic agreement and records
By checking the acceptance box, typing a full legal name and submitting, the renter agrees to conduct this transaction electronically and intends to sign this agreement. The selected package, dates, addresses, terms, signature and server timestamp will be retained with the reservation. The renter may download or print a copy after submission.
14. Privacy and communications
Contact, address and reservation information is used to schedule, deliver, collect payment, communicate about and document the rental. Information may be shared with service providers only as needed to operate the reservation, process payment or comply with law. The company does not sell renter information.
15. Florida law; entire agreement
Florida law governs this agreement. If a provision is unenforceable, the remaining provisions continue in effect. These terms and the accepted reservation details form the entire agreement unless both parties approve a written change. Failure to enforce a term once does not waive it later.
